Law Suit No. FHC/ABJ/CS/439/2005

  1. In 2005, the National Universities Commission of Nigeria (NUC) visited my office in Kaduna and threatened to close down the office alleging that I, Senator Professor David Iornem was carrying out illegal activities by being agent and consultant to foreign universities. They also said that to advise or serve as a consultant to a student studying on distance learning programme of a foreign university, or to advise or serve as a consultant to any Nigerian wishing to enrol on a distance learning programme of any foreign university was illegal and against Laws of the Federation of Nigeria. The NUC team was led by one certain Professor Uvah.

    3. I proceeded to the Kaduna High Court where I swore to an Affidavit of facts relating to my business as a management         consultant, training and educational consultant. Click here to view the affidavit.

 

                                                                  

    4. I also immediately wrote to the National Universities Commission (NUC) attaching my Affidavit of the Facts About My         Business. Click here to view my Response to NUC.

 

                                                                     

5. I was shocked that the next thing NUC did was to use the SSS to close my office in Lagos. Up till now, I have not recovered from the effects of this illegal use of State Security on Citizen David Iornem. The SSS in Kaduna were more circumspect. They invited me for interview and told me that there was a plan to stop my business activities but they were studying what it was all about before they would act. They promised to get back to me after collating their facts.

6. The use of Security Agency in LAGOS

A certain Security Agency in Lagos was used to shut down my office. I travelled to Lagos with two big boxes containing books and publications on distance learning to demonstrate that I was involved in a practicing branch of learning and philosophy that is not new but well developed and documented. When I arrived, someone thought I brought money to do the Nigerian thing. You can imagine the disappointment and anger when I opened my first box and someone girraffed and saw “useless” books. I managed to escape from the anger but without succeeding to get my Lagos office reopened. I headed to Abuja where I met the Director General of the Security Agency and upon his intervention, the NUC was told that they could not use the Security agency in that way.

7. LAW SUIT

I immediately filed an Origination Summons, praying the court to invite the NUC to show me any Nigerian Law that I was contravening by my business activities. 8. It took NUC from 2005 to 2009 (five good years) to find “evidence” to prove that I was involved in illegal activities. 9. The NUC went on appeal. Recently, the National Universities Commission (NUC) lost the appeal. They have applied to amend certain aspects of their appeal so that it can be revived and heard again. Their application or motion is coming up in October.

10. NATIONAL UNIVERSITIES COMMISSION (NUC) CORRUPTION OF THE JUSTICE PROCESS AND ABUSE OF FUNDAMENTAL HUMAN RIGHTS

In a twist of events, the National Universities Commission (NUC) abandoned the due process which I had initiated against them in a court of competent jurisdiction and reported me to the ICPC alleging that my educational consultancy services are corrupting the Nigerian education system.


ENTER THE ICPC

11. The ICPC relying on allegations from the NUC promptly raided my offices, arrested my staff and carted away with my computers and documents. When I reported at their office, I was promptly arrested and detained. I was released on bail after meeting stiff administrative bail conditions. When I went to the bank to transfer funds and cash money to pay for tickets and other expenses for a foreign training programme for my clients, I was told that my bank account has been frozen by the ICPC.

12. I went to court to get an order to open my account and the ICPC lured me back into another net by phoning me, pretending to be friendly and then informing me that they had concluded their investigation and that they were happy with me. They then said I should come to their office to collect my documents and to discuss the way forward for my frozen bank account. I was expectedly enticed and I went.

 

13. On getting there, I was given a dressing down on why I went to court to make a request to a court judge to vacate an order ICPC had obtained through a motion exparte (secrete motion obtained against someone without letting him know). I begged them that I was only following due process and since I thought they were acting legally, I should also use the same legal route to defend my rights. They then told me that my bail was withdrawn and that is how they threw me into their detention. The following day, they took me to court like a common criminal, collaborating with the National Universities Commission to bring pressmen to cover a conspiracy between the NUC and the ICPC. I will not talk about the court case instituted by the ICPC yet because it will be prejudicial or subjudice.  We leave that for another day. This is the whole truth and nothing but the truth about the matter.
